1. Scope
These Terms of Use apply to the use of the "Cook&Track" app (hereinafter "App"), provided by:

By using the App, you accept these Terms of Use.
2. Service Description
Cook&Track is an app for tracking meals and managing recipes. The App offers:
- Free features: Meal tracking, recipe management, basic statistics
- Premium features (paid): Ad-free experience, recipe sharing, advanced features
3. Premium Subscription
3.1 Prices and Duration
Current prices for Premium subscriptions are displayed in the App Store. Various subscription periods are available (e.g., monthly, yearly).
3.2 Purchase and Payment
The purchase contract is concluded with Apple Inc. as the contractual partner. Payment is processed through your Apple ID account. Apple handles all payments and issues invoices.
3.3 Automatic Renewal
Subscriptions automatically renew for the selected period unless you cancel at least 24 hours before the end of the current period.
3.4 Cancellation
You can cancel your subscription at any time in your Apple ID account settings. Cancellation takes effect at the end of the current billing period. Amounts already paid will not be refunded.
3.5 Restore Purchases
When changing devices, you can restore your purchases using the "Restore Purchases" function in the App.
4. Advertising
The free version of the App contains advertisements from third-party providers. Advertising is disabled by subscribing to Premium.
5. Usage Rights
You receive a simple, non-transferable right to use the App on your personal devices. It is prohibited to:
- Decompile the App or extract the source code
- Redistribute the App for commercial purposes
- Use the App for illegal purposes
6. User Content and Import
6.1 Your Own Content
You can create and store your own recipes, notes, and photos in the App. You warrant that you have all necessary rights to any content you add and that you do not infringe any third-party rights (including copyrights, personality rights, or trademark rights).
6.2 Importing External Recipes
The App allows you to import recipes from external sources (e.g., websites). Metadata such as title, ingredients, preparation steps, and images are automatically extracted. The original source is automatically linked to the recipe. You are responsible for only importing content that you are permitted to use.
6.3 Local Storage
All your content is stored exclusively on your device and in your personal iCloud. We have no access to your stored recipes, photos, or other data and do not operate any central database for storing user content.
6.4 Responsibility When Sharing
Imported recipes should primarily be used for private, non-commercial purposes. When sharing content (e.g., export, sharing), you are solely responsible for ensuring that source attribution is maintained and no copyrights are violated.
7. Health Disclaimer
Important: Cook&Track is a tool for personal organization and does not replace medical or nutritional advice.
- The App does not provide health recommendations
- Nutritional values are for guidance only and may be inaccurate
- For health-related questions, please consult a doctor or nutritionist
8. Limitation of Liability
We are not liable for:
- Data loss due to device damage, uninstallation, or technical errors
- Consequences arising from the use of information stored in the App
- Inaccuracies in imported recipes or nutritional values
- Interruptions or unavailability of the App
- Content created or imported by users, as this is stored locally only and is not accessible to us
This limitation of liability does not apply to intent, gross negligence, or breach of essential contractual obligations.
9. Availability and Changes
We reserve the right to:
- Update the App and change features at any time
- Discontinue operation of the App (with reasonable notice)
- Modify these Terms of Use
You will be notified in the App of any significant changes.
10. Privacy
Information about how we process your data can be found in our Privacy Policy.
11. Governing Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer protection provisions of their country of residence also apply.
12. Severability
If any provision of these Terms is found to be invalid, the validity of the remaining provisions shall not be affected.
